The Township appeared before Superior Court on Tuesday, October 8, 2024, seeking temporary restraints against the Mount Olive Villages Sewer Company, Inc. Unfortunately, the Judge took the position that the actions taken by the New Jersey Department of Environmental Protection (NJDEP) demonstrate that there is no irreparable harm to the Township which would require the temporary restraints. However, on a positive note, the Township has gained momentum as the Judge did order Mount Olive Villages Sewer Company, Inc. to retain an independent engineer within ten (10) days, which was required by the NJDEP, and provide the investigation report to the Township. If the independent engineer is not retained, the Township has the right to submit an order instituting the original restraints.
We will continue to keep you apprised as this case develops and will not be satisfied until all of the ongoing complaints and concerns have been resolved.
In the meantime, if you continue to experience nuisance odors, we encourage you to report them by calling the NJ DEP’s 24-hour environmental hotline at 1-877-WARN-DEP (1-877-927-6337). After your initial call to the DEP hotline, please follow up with one more phone call to the Mount Olive Health Department by calling 862-419-4131 so that the Township can investigate the incident independently.
